Terms of Use

1. Overview of Service

Cradle is a cloud-based platform designed for creative professionals to store, manage, and share work-in-progress and completed files and assets. Users may invite up to 10 collaborators per project to access shared content.

2. Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use Cradle.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that collaborators you invite comply with these Terms

We reserve the right to suspend or terminate accounts that violate these Terms.

4. File Storage and Security

All files uploaded to Cradle are encrypted and stored in secure cloud infrastructure.

Access to files is restricted to the account owner and explicitly invited collaborators.

While we implement reasonable security measures, no system can be guaranteed to be completely secure.

5. User Responsibilities

You agree not to upload, store, or share content that:

• Is illegal, harmful, or offensive
• Violates intellectual property rights
• Contains malware, viruses, or harmful code

You are solely responsible for all content you upload and share via Cradle.

We are not responsible for any content shared by users, including inappropriate or unlawful material.

6. Data Integrity and Liability

We implement backup systems for stored files. However:

• We do not guarantee that files will never be lost, corrupted, or damaged
• We accept no financial liability for any data loss, corruption, or service interruption

You are responsible for maintaining your own backups where necessary.

7. Storage Limits and Usage

• Free accounts include 10GB of storage capacity
• If an upload exceeds your available storage, you will be required to upgrade before proceeding

8. Paid Plans and Billing

• Paid plans provide additional storage capacity
• All pricing is in USD and billed on a monthly subscription basis
• Payments are processed via Stripe
• Cradle does not store or have access to your payment details

Subscription Terms:

• Subscriptions automatically renew unless cancelled
• Cancellation takes effect at the end of the current billing period
• Accounts will downgrade after the billing period ends

9. Downgrades and Data Retention

If you downgrade your plan:

• You may exceed your storage limit
• We reserve the right, over time, to remove or clear stored data (including backups) if your usage exceeds your allowed capacity and you do not upgrade

We will make reasonable efforts to provide notice where possible.

10. Intellectual Property

You retain ownership of all content you upload to Cradle. By using the service, you grant us a limited license to store, process, and transmit your content solely to provide the service.

11. Service Availability

We aim to provide continuous access but do not guarantee uninterrupted service.

We may suspend or modify the service at any time without liability.

12. Limitation of Liability

To the maximum extent permitted by law:

• Cradle is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid by you in the preceding 12 months

13. Termination

We may suspend or terminate your access if:

• You breach these Terms
• We are required to do so by law

You may stop using the service at any time.

14. Changes to Terms

We may update these Terms from time to time. Continued use of Cradle constitutes acceptance of any updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
